When hiring flexiworkers, we enter into fixed-term employment contracts with them based on a minimum (which is always ‘0’ hours) and maximum number of hours.
The arrangements between a flexworker and EURflex are set out in an employment agreement. This consists of the Payroll Agreement (general terms and conditions), the Payroll Tax Statement (income tax and social insurance contributions) and the Assignment Confirmation (details of the assignment, position and working conditions). Depending on the client’s requirements, the following contractual aspects may vary:

A student-assistant is registered as a student at a university and works at the EUR. These activities may focus on scientific research or education (student assistant WOO) or exclusively on operational tasks (student assistant BVT). The Student-Assistant Regulations apply. EURflex follows these regulations.
Confidentiality
Employees of EUR, EUR Holding and EE Holding all have a duty to maintain confidentiality. The same applies to flexiworkers. In short, you may not share information about EUR, EUR Holding or EE Holding, its employees or its business relations with others during the term of your employment contract or after it ends. All information, of whatever nature, will remain the property of EUR, EUR Holding and EE Holding. Read Article 9b of your employment contract for more information Employee acknowledges that he/she is obliged to treat as confidential all particulars relating to EUR, its undertakings, its affiliated companies and business contacts. Neither during the duration of the Payroll Agreement nor after its termination may Employee pass on to third parties any particulars in respect of EUR, its employees and/or business contacts. All documents and/or copies of such, of whatsoever nature, and all items given in loan or otherwise, which were acquired or used on the basis of the Payroll Agreement, are and remain the property of Employer, even if these documents and/or items and/or electronic files were produced by Employee.
Code of Integrity
Flexiworkers are expected to practise science with integrity and to comply with the Netherlands Code of Conduct for Research Integrity. Flexiworkers are also expected to familiarise themselves with the Code of Integrity of Erasmus University Rotterdam and/or Integrity Regulation 2021 EUR Holding and to undertake to comply with these codes, the applicable house rules and work instructions.
With regard to the complaints regulation, this regulation will be followed as it applies to EUR Holding and its operating companies, as EURflex is part of EUR Holding. Click here for the codes of integrity.
An employment contract can expire for a number of reasons. For example, when the term of the contract has come to an end by operation of law, or cases where the flexiworker wishes to terminate the employment contract. When an employment contract expires, it is possible to renew the contract, conditional to applicable legislation and regulations. When renewed within 6 weeks, the job continues without a final settlement taking place.
Work and Security Act provisions on succession of fixed-term employment contracts and successive term of employment
The provisions on succession of fixed-term employment contracts are statutory provisions governing how many temporary employment contracts can be concluded before an employment contract for an indefinite period arises. An employment contract for an indefinite period between an employer and employee can result as a consequence of the provisions on succession of fixed-term employment contracts if the employer and employee have entered into multiple fixed-term employment contracts (a maximum of three contracts) while the period between the contracts has not exceeded six months, and the total duration of these employment contracts, including intervals, has not exceeded a period of 36 months. After 36 months, the last employment contract is deemed to be entered into for an indefinite period. The provisions on succession of fixed-term employment contracts also apply if the same or similar job activities are carried out for different employers deemed to be each other’s successors. This is referred to as a successive term of employment. This means that if the employee is carrying out the same or similar work activities for the new employer, the employee enjoys legal protection resulting from the provisions on succession of fixed-term employment contracts. For a successive term of employment, previous employment contracts entered into with EUR therefore also count.
The succession rule also applies if there is the performance of the same or similar work for different employers deemed to be each other’s successors, so-called successive employership. This means that if the employee performs the same or similar work for the new employer, the employee enjoys legal protection of the chain of employment regulations. For successive employership, therefore, previous employment contracts entered into with the EUR also count.
EURflex is responsible for the payroll of flexiworkers at Erasmus University Rotterdam.
